Release/Indemnity for participation with Optima Skating Methods

 

I confirm that it is my desire to participate in ice hockey and related activities being provided and sponsored by Optima Skating Methods LLC, a hockey development organization conducting programs related but not limited to Training Camps, Development Programs, Elite League, Futures League, Training Groups, and Skill Sessions. It is my full understanding that Optima Skating Methods LLC programming will be conducted at an array of ice arenas across the country and that in consideration of the agreement by Optima Skating Methods LLC to permit my participation in any and all activities for which I enroll (“the activities”), do state that:

 

1.    The “Activities” covered by this document include but are not limited to all athletic activities which I (or my child/minor) attend or in which I (or my child/minor) participate, including instruction, practices, scrimmages, off-ice workouts, and contests or games.

2.    I acknowledge that injuries are inherent to any physical activity and I assume all risks and dangers attendant to my (or my child/minors) participation in the activities;

3.    I warrant that I have accident and health insurance coverage that will cover me (or my child/minor) while participating in all such activities; I understand that I shall retain full financial responsibility for any medical care I (or my child/minor) may require as a result of my (or my child/minors) participation in the Activities and all related expenses. I hereby release, and agree to indemnify and hold harmless, Optima Skating Methods LLC, its administrators, coaches and staff, supervisors, employees, agents, and all private persons or organizations engaged by Optima Skating Methods LLC from any claim or liability in any manner related to any such medical care or expenses.

4.    In the event of a medical emergency, and if I am unable to make decisions for myself (or my child/minor) related to treatment, I hereby give permission for representatives of Optima Skating Methods LLC to arrange for/and/or authorize emergency medical treatment on my behalf.

5.    I agree to release, indemnify, protect, defend and hold harmless, Optima Skating Methods LLC, its administrators, coaches and staff, supervisors, employees, agents and all private persons or organizations engaged by Optima Skating Methods LLC from any claim or liability or whatsoever kind or nature, including but not limited to personal injury, including loss of life, or loss of any kind and/or property damage, court costs, attorneys’ fees and interest, resulting from, or arising out of, my (or my child/minors) participation in the Activities, other than any such claims or liabilities arising out of gross negligence or wilful misconduct;

6.    I agree to abide by all rules and/or regulations on conduct established by the arena venue, Optima Skating Methods LLC, and all instructions and/or directions of instructors and all other persons engaged by Optima Skating Methods LLC to supervise the Activities and to refrain from any conduct which might be detrimental to or incompatible with, the interest, comfort or welfare to those participating in the Activities. I understand that my (or my child/minors) participation in all Activities will be conditioned upon my conduct and compliance with all such rules, regulations, instructions and/or directions and that my (or my child/minors) right to participation in any Activities may be terminated by Optima Skating Methods LLC in the event of any violation of or noncompliance with such rules, regulations, instructions and/or directions.

7.    I agree to release Optima Skating Methods LLC any and all rights I have to photographic, audio, or video images of me (and/or my minor child(ren) and any and all rights I have to the audior/video recording of my voice or the voice(s) of me (or my child/minor.) I hereby agree to release to Optima Skating Methods LLC, the rights to the use of any photographic, audio, or video images, recordings, or reproductions of me (or any of my child(ren)/minor) in any advertising or marketing/promotional use as deemed necessary or useful at the exclusive option of Optima Skating Methods LLC. I GIVE MY EXPRESS PERMISSION TO THE USE OF SUCH RECORDINGS OR IMAGES.

8.   I agree to release and discharge Optima Skating Methods LLC from any claim, loss, or damage of any kind or nature arising out fo the use of photographic, video, and/or audio images, recording or reproduction of me and/or my child(ren).
